Copyright and DMCA Policy
My Beauty App respects the intellectual property rights of others. This Copyright and Digital Millennium Copyright Act (“DMCA”) Policy applies to My Beauty App’s website, applications, directory and search features, listings, profiles, photographs, portfolios, reviews, posts, links, and other material made available through the service.
Reporting Copyright Infringement
If you believe that material available through My Beauty App infringes a copyright that you own or are authorized to enforce, submit a written notice through our customer-support contact form and begin the message with “Copyright/DMCA.” To help us locate the material quickly, identify each specific page, listing, image, or file by its direct URL whenever possible.
A substantially compliant notice must include:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works on one online site are covered, a representative list of those works.
- Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient for My Beauty App to locate it.
- Your name and information reasonably sufficient for us to contact you, including a mailing address, telephone number, and, if available, an email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.
Please do not submit ordinary listing corrections, privacy requests, trademark complaints, or removal requests as DMCA notices unless the issue is genuinely copyright infringement. Those matters should be submitted through our customer-support contact form.
What We Do After Receiving a Notice
My Beauty App reviews notices for substantial compliance. When a notice is effective, we act expeditiously to remove or disable access to the identified material and take reasonable steps to notify the user who provided it. We may send the notice, including the complaining party’s contact information, to that user. If a notice identifies the copyrighted work, the material at issue, and a way to contact the sender but is otherwise incomplete, we may request the missing information or take other reasonable steps to assist the sender.
Removal or restriction does not necessarily mean that My Beauty App has determined that infringement occurred. We may preserve relevant records and may provide information when required by valid legal process.
Counter-Notification
If you believe your material was removed or disabled because of mistake or misidentification, you may submit a written counter-notification through the same customer-support contact form and begin the message with “DMCA Counter-Notification.” A substantially compliant counter-notification must include:
- Your physical or electronic signature.
- Identification of the material removed or disabled and the location where it appeared before removal or disabling.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification.
- Your name, address, and telephone number, plus a statement that you consent to the jurisdiction of the appropriate United States federal district court for your address—or, if your address is outside the United States, a federal district where My Beauty App may be found—and that you will accept service of process from the person who submitted the original notice or that person’s agent.
After receiving an effective counter-notification, we will promptly provide a copy to the original complaining party and inform that party that we may restore the material. Unless we receive notice that the complaining party has filed a court action seeking an order restraining the user’s allegedly infringing activity, we may restore access no sooner than 10 and no later than 14 business days after receiving the counter-notification.
Repeat-Infringer Policy
My Beauty App has adopted and reasonably implements a policy providing for the suspension or termination, in appropriate circumstances, of users, account holders, listing owners, and other subscribers who repeatedly infringe copyright. We may also restrict listings, uploads, or new accounts used to evade enforcement.
We evaluate repeat-infringer matters in context. Relevant considerations may include the number and reliability of notices, whether the matters concern distinct works or claimants, counter-notifications, retractions, court outcomes, evidence of authorization, deliberate reposting, account evasion, and other evidence of a pattern. We do not treat every allegation as a final judicial determination of infringement, but a court judgment is not required before we take appropriate action under this policy.
Standard Technical Measures
To the extent applicable, My Beauty App accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works that satisfy the requirements of 17 U.S.C. § 512(i).
Misrepresentations
Knowingly and materially misrepresenting that material is infringing, or that removed material was removed by mistake or misidentification, may result in liability under 17 U.S.C. § 512(f). Consider consulting qualified counsel before submitting a notice or counter-notification.
Policy Changes
We may update this policy to reflect changes to our services, procedures, or applicable law. The date above identifies the most recent revision.
